We understand you need to know how much the case will cost you from the outset of the claimThere are numerous ways in which you can fund your Professional Negligence Claim. These are set out below:
Conditional Fee AgreementA no win no fee agreement is also known as a Conditional Fee Agreement. Under the terms of this agreement, we agree not to charge you for our fees until your case has settled. If your claim is successful, most of our fees will be paid by the Defendant. In the event that your case is unsuccessful, we will again not charge you our fees.
Legal Expenses Insurance (ATE Insurance)In the event you do not have the benefit of Before the Event Insurance we will discuss the funding options available to you, in some cases the most suitable form of insurance would be an After the Event Insurance Policy. An After the Event Insurance Policy covers the Defendants costs which they would be awarded should your case not be successful.
Private Funding AgreementThis funding option is when we act on your behalf on an agreed hourly basis. The hourly rate will depend on the complexity of the claim and the level of experience of your Solicitor. An initial payment will be required followed by interim payments depending on the complexity of the matter and the amount of work completed. We will send you regular updates with the cost of work completed to date.
Damages Based AgreementInstead of having to pay up front fees you have the option to have a percentage of the recovered damages deducted. The agreed percentage will be agreed at the start of the claim and will depend on the complexity and value of your claim.
If the claim fails you pay us nothing!
Legal Expenses Insurance (BTE Insurance)You may have the benefit of ‘before the event’ insurance which could cover you for legal costs. We recommend that you check your household, motor insurance and credit card policies.
