Accidents Abroad

For many of us, Eurostar and the Channel Tunnel have made it easy for us to drive abroad in our cars, motor homes , motorised caravans, or to ride our motor bikes; in the summer particularly the volume of vehicles travelling abroad is enormous.

Until the end of 2007, UK motorists travelling abroad did not have the option to sue a person responsible for causing an accident abroad in this country, meaning the only option was to sue the foreign driver who caused the accident in their own country - often a daunting and expensive procedure which put off all but the wealthy or well connected motorists. For this reason, many victims who return to this country injured and out of pocket decide not to recover compensation and losses, and are left without a remedy.

As a result of a ruling in December 2007 by the European Court of Justice the position has changed to the benefit of UK Motorists. The court ruled that an injured party can bring an action in the UK against the insurer of a motorist responsible for their accident, in the UK courts, providing the other motorist is insured in another member country of the EC and the law of that country permits a claim of this nature. As a result of this ruling, EU policyholders should now be able to have their cases against EU insurers heard in their home courts provided their own national law allows it.

This means that a UK motorist, injured in a car crash in France, by a French national, will be able to sue the French driver’s insurers, in the UK Courts, and receive damages agreed under UK law.
