What should I do following a motor accident?

If you are involved in a motor accident where someone other than you has sustained a personal injury or property damage, then you must stop and exchange details with that person, including name and address, company name, vehicle registration number and insurance details. Do not make any admissions about liability at this stage - please speak to us first.

If the other party fails to stop and/or has not been able to provide a name and address, car registration number or insurance details to you following the motor accident, then you must make a formal complaint to the police as soon as possible. You are entitled to do this as a refusal to give insurance information is a criminal offence under Section 154 of the Road Traffic Act 1988. We can still assist you with a claim against an uninsured or untraced driver.

It is also important that you call the police straight away if you or the other party sustains an injury so that the police can compile a motor accident report at the scene and take statements from everyone involved.

If there are any witnesses to the accident, it would be helpful to your claim to obtain their name, address, and telephone number in case further evidence is required. If you have a camera phone, then please take pictures of the vehicles following the accident showing their positions and the damage sustained.
