What is a motor accident?

A motor accident usually involves at least one road vehicle being in collision with another vehicle, another road user, or a stationary roadside object, and which may result in personal injury or property damage. Road vehicles generally include cars, vans, lorries, trucks, buses, motorbikes and bicycles.

Other phrases used to describe motor accidents include: road traffic accidents (RTA), road traffic incident (RTI), car crash, car smash, motor vehicle accident (MVA), personal injury collision (PIC), road accident, road traffic collision (RTC), smash-up, and traffic collision.

Motor Accidents Abroad

For many of us, Eurostar and the Channel Tunnel have made it easy for us to drive abroad in our cars, motor homes , motorised caravans, or to ride our motor bikes; in the summer particularly the volume of vehicles travelling abroad is enormous.

Until the end of 2007, UK motorists travelling abroad did not have the option to sue a person responsible for causing an accident abroad in this country, meaning the only option was to sue the foreign driver who caused the accident in their own country - often a daunting and expensive procedure which put off all but the wealthy or well connected motorists. For this reason, many victims who return to this country injured and out of pocket decide not to recover compensation and losses, and are left without a remedy.

As a result of a ruling in December 2007 by the European Court of Justice the position has changed to the benefit of UK Motorists. The court ruled that an injured party can bring an action in the UK against the insurer of a motorist responsible for their accident, in the UK courts, providing the other motorist is insured in another member country of the EC and the law of that country permits a claim of this nature. As a result of this ruling, EU policyholders should now be able to have their cases against EU insurers heard in their home courts provided their own national law allows it.

This means that a UK motorist, injured in a car crash in France, by a French national, will be able to sue the French driver’s insurers, in the UK Courts, and receive damages agreed under UK law.

Taxi Passenger Motor Accidents

Many thousands of people use taxi’s daily. Although most taxi drivers are professional and well trained, it is inevitable that accidents involving taxis will happen at no fault of the driver. When a taxi is involved in an accident, as a passenger you will be viewed as an innocent victim.

It is often the case that taxi passengers are injured as they have very little warning that an accident is about to happen and no opportunity to prepare themselves. If you have been injured in a taxi motor accident, you are legally entitled to claim compensation unless you caused, or contributed to, the accident. In addition to pursuing your injury compensation, to assist your recovery, we can arrange private medical treatment for you and claim back your medical expenses. If you have been unable to work as a result of the taxi accident, we can pursue a claim for loss of earnings on your behalf.

Your claim will be dealt with by an experienced solicitor and we will pursue compensation from the insurers of the responsible driver, which may be the taxi driver or the driver of another vehicle which caused the accident.

Uninsured or Untraced Drivers

It is compulsory for drivers of vehicles to have insurance, but a claim can still be made even if the driver at fault was not insured or failed to stop following the accident. In these circumstances a claim can be submitted to the Motor Insurers Bureau (MIB).

The MIB is an organisation which protects victims of Uninsured/Untraced driver’s. They will conduct investigations into your motor accident claim as well as investigations as to the identity of the responsible party.

Once their investigations are completed they will be in a position to consider making an award under the Uninsured Driver’s agreement or alternatively the Untraced Driver’s agreement and we will negotiate settlement of your claim with the Motor Insurers Bureau on your behalf to ensure you receive the compensation you deserve.
